The legal bits that govern your use of nebesno.

1. Introduction

Welcome to nebesno. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. nebesno connects businesses and individuals ("Clients") with agencies and freelancers ("Partners") for digital projects.

2. Definitions

"nebesno", "we", "our" or "us" means the sole proprietorship Nebesno, Danish CVR no. 45541843, which operates the Platform. "Platform" refers to the nebesno website and all associated services. "Client" means any user who posts a project brief or seeks services. "Partner" means any agency or freelancer who offers services through the Platform. "Project" means any work engagement initiated through the Platform.

3. User Accounts

You must create an account to use certain features of the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate, current, and complete information.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Partner Responsibilities

Partners represent that they have the skills, licenses, and authority to perform the services they offer. All work samples and descriptions submitted to the Platform must accurately represent the Partner's own work.

Partners agree to respond to briefs in a timely manner and to deliver work that matches the scope agreed upon with the Client. Failure to do so may result in removal from the Platform.

5. Client Responsibilities

Clients agree to provide clear, accurate briefs and to communicate in good faith with Partners. Clients must not use the Platform to solicit work and then circumvent the Platform to avoid fees.

6. Fees & Payments

nebesno may charge fees for certain services, including but not limited to project success fees or promoted listing fees. All fees will be clearly disclosed before they are incurred. Payment terms are governed by our separate Payment Policy.

7. Intellectual Property

Upon full payment, the Client receives full ownership of the deliverables created by the Partner, unless otherwise agreed in writing. Partners retain the right to display work in their portfolio unless a confidentiality agreement prohibits it. nebesno claims no ownership over user-generated content posted on the Platform.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose
  • Impersonate another person or entity
  • Post false, misleading, or deceptive content
  • Attempt to circumvent our fee structure
  • Harvest user data without consent
  • Interfere with the Platform's operation or security
  • Post or send hateful content, hate speech, harassment, threats, or content that demeans or discriminates on the basis of race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, age, disability, or any other protected characteristic
  • Post or send nudity, sexually explicit or pornographic content, or offer or solicit sexual services
  • Post or send graphic violence, gore, or content that glorifies or incites violence, terrorism, extremism, self-harm, or suicide
  • Post content that promotes or facilitates illegal drugs, weapons, human trafficking, or other unlawful goods and services
  • Upload sexual content involving minors in any form (zero tolerance: such accounts are terminated immediately and reported to the authorities)
  • Post content that exposes another person's private information without consent, or share intimate images without consent

9. Content Standards & Enforcement

All content you upload to the Platform, including profiles, portfolios, service descriptions, briefs, reviews, images, and messages, must comply with Section 8. These rules apply both to public content and to private messages between Clients and Partners.

In the event of a violation, nebesno may, at its sole discretion and without prior notice, take one or more of the following measures, depending on the severity and recurrence of the violation:

  • Remove or hide the content in question
  • Issue a written warning
  • Temporarily suspend your account and your access to the Platform
  • Permanently terminate your account and ban you from future use of the Platform
  • Report the matter to the police or other relevant authorities

Severe violations, including sexual content involving minors, threats of violence, terrorism-related content, and human trafficking, result in immediate and permanent removal without prior warning. Where an account is terminated for a violation, no refund of any fees paid will be given, and you may not create a new account.

You can report content or conduct that violates these Terms using the report function on profiles and in conversations, or via our contact page. We review reports and take the measures we consider necessary. If you believe your account was terminated in error, you may contact us to have the case reviewed.

10. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind, either express or implied. nebesno does not guarantee that the Platform will be uninterrupted, secure, or error-free. We are not responsible for the quality, safety, or legality of services provided by Partners on the Platform.

11. Limitation of Liability

To the maximum extent permitted by law, nebesno shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform, including but not limited to lost profits or business interruption.

12. Termination

Either party may terminate these Terms at any time by discontinuing use of the Platform. nebesno reserves the right to terminate or suspend access to the Platform immediately, without prior notice, for any breach of these Terms.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms.
